This is not a publicly released wallet. If it was, these terms would be bettter. If you're a tester of the wallet, these terms apply to you.
You should brush your teeth daily, eat well, get plenty of exercise, and you should use a more secure wallet. Everyone should store cryptocurrency on hardware wallets, kept in duplicate, and they should transact only on rare occasions with secure devices, and probably should use mixers or Tornado Cash to make sure people can't track them. But people also live short lives and are willing to take some considered risks in favour of things that are of value to them. This is one of those things. There are some very important downsides to doing things the way this computer program does, and you should know that you are running downloaded software - this is not a managed service.
This software is like Microsoft Word installed on your computer: if you delete the document, you can’t call up Word and get them to get it back for you. If you delete a file on your Mac, and then empty the recycling bin, Apple technicians can’t get it back for you. This software has no way of accessing your cryptocurrency, and that’s a really good thing, but it also means there’s no way to recover it for you if you delete/overwrite/lose your 12 word backup phrase. This is the most important thing to know, but there are lots of other details about this software, and the overall contract that governs its use that is below.
These legal terms cover your use of Bask Wallet. You should carefully read these terms because they describe Bask Wallet, risks you assume while using it, and important limits on your legal rights with respect to Bask Wallet (i.e. limitation of liability).
Bask Wallet is a product of Addison Cameron-Huff (“Developer”), a lawyer/programmer based in Toronto.
Bask Wallet is for interacting with smart contracts on Solana. This agreement uses the term “Bask Wallet” to mean the software (“Bask Wallet Software”) and backend proxy services and price fees from third-party services (“Bask Wallet Backend”).
Bask Wallet is experimental software for a new paradigm of on-chain assets involving DEXs and tokenized assets. It is not the most secure wallet, because the most secure wallet is a hardware wallet accessed from a dedicated computer. Bask Wallet is designed to privilege speed and ease of use over technical security, because there are trade-offs inherent in different types of wallets.
Bask Wallet is most like a web browser for your digital assets, and not at all like a storage service that a company controls. What this means for you: there is no person or company who is storing your digital assets, the Developer does not have any control over your digital assets and does not manage your digital assets. No entity can or is selling or transferring your digital assets because all interactions are on-chain. Due to this model, the Developer cannot recover any of your digital assets if you lose access (due to not backing up your private keys, which are derived from the 12 word seed which is found at the bottom of the user interface of Bask Wallet).
If you’re an adult who understands digital assets and you live in a place that the Backend Services don’t block then you can use Bask Wallet. If Bask Wallet is illegal in your jurisdiction or you have become subject to sanctions by a government, anywhere in the world, then you cannot use Bask Wallet. Bask Wallet is licensed to you on a personal, non-transferable, non-sublicensable basis for you to install and operate the software. Bask Wallet also contains open-source software components that are licensed to you separately, and you can write to the Developer to obtain a list of the open-source components.
Developer may decide to turn off access to certain regions, in accordance with legal obligations, at any time, and your sole remedy shall be to discontinue using Bask Wallet. You will always have your 12 word backup that you can use with many other compatible wallets, such as Phantom, a popular Solana wallet. In this sense, you can never lose access to your cryptocurrency, only to the Bask Wallet.
The Bask Wallet Software is free to use, but when you interact with certain smart contracts, there may be a tip amount proposed. You are not obligated to tip, and can always choose to do transactions using a different wallet.
Notwithstanding any term of this agreement, our liability to you shall be limited to $50 Canadian Dollars. You expressly acknowledge that $50 is a reasonable limit, and the rationale for this limit is that the Bask Wallet Software is free to download and install on your device, and this limitation of liability is essential to the ability to offer Bask Wallet to you at all.
Bask Wallet (including its online service components and installable software components) is distributed to you without any warranty of any kind, on an “as-is” basis, and it is not warranted that it will continue to be available to you or that you will not experience interruptions to any part of Bask Wallet or its supporting services.
There are also many risks that are specifically disclaimed and for which the Developer takes no responsibility for: a) high Solana fees due to popularity of the network, slippage/liquidity issues on DEXs, failure of a DEX to complete a transaction, failure of a stablecoin or other digital asset that results in a loss of value, incorrect generation of seeds/private keys, or bugs in the software. Developer shall have no liability to you in the event that one of these risks befalls you, and this shall apply whether the liability is founded in tort, contract, statute, or any other legal basis.
You may not modify Bask Wallet.
Developer can assign this agreement to any other entity as part of the sale of all or substantially all of our business (or Bask Wallet itself) by posting a notice at baskwallet.com. You may not assign this agreement.
The Developer can amend this agreement after providing you with 15 days notice of our intention to do so.
If you live in a jurisdiction where your local law trumps, negates, or prohibits any part of this agreement (such as the limitation of liability provisions) then the offending provision(s) shall be severed and the remaining terms shall apply.
Any disputes related to your use of Bask Wallet or this agreement shall be resolved in the courts of the City of Toronto, Ontario, Canada, and you agree that this shall be the exclusive jurisdiction for resolving disputes. You shall indemnify the Developer against any costs incurred b due to you bringing an action elsewhere.
The laws of the Province of Ontario shall apply to the resolution of any dispute.
The Developer may terminate this agreement, and consequently prohibit you from accessing Bask Wallet, by providing you with 30 days notice of the intention to do so.
You may terminate this agreement by providing notice and immediately uninstalling the software from your device(s). You may also simply stop using the software, as there is no cost to use it and all transactions, cryptocurrency, digital assets, and history are on-chain.
This is the entire agreement between the parties with respect to Bask Wallet. This agreement supersedes any other understandings, representations, or agreements.
You acknowledge that you have not relied on any statements made outside of the terms of this agreement in coming to your decision to agree to this contract and use Bask Wallet.
This Privacy Policy describes how we handle information when you use Bask Wallet. Our approach is built on the principle of data minimization: we do not want your personal information, and our software is engineered to ensure we collect as little of it as possible.
The developer of Bask Wallet is responsible for the information handled by the Bask Wallet Backend. Because the software is user-installed and user-controlled, there is no controller of your personal information. There is no way to provide your name, email, address or other details as part of using Bask Wallet.
When you use Bask Wallet, our backend infrastructure serves a single technical purpose: acting as a passthrough proxy to facilitate your interaction with the Solana blockchain and third-party data providers (such as price feeds). This is a technical necessity. The service does not interact with any of the data that passes through the proxy.
We do not use your technical data for marketing, profiling, or any purpose other than the immediate functional requirements of the software.
We limit the collection of information to only what is strictly necessary to operate the proxy service.
Technical Logs: Our servers (located in Montreal, Canada) may temporarily log technical identifiers, such as your IP address, to manage network traffic and prevent service abuse. There are certain necessary network identifiers that are inherently passed along as part of HTTPS requests, and these are incidentally collected and then purged (see below).
Automatic Deletion: We do not maintain long-term records. All backend logs are automatically deleted after 24 hours.
Personal Identity Data: We do not collect names, email addresses, or government identification. The software functions without a user account. The software is merely installed Javascript code that runs within your device’s secure environment.
Cryptocurrency addresses and other data are not collected and stored.
We employ technical safeguards to protect the integrity of our backend proxy. However, because Bask Wallet is a non-custodial tool, the primary security of your digital assets and private information rests with you:
Local Storage: Your private keys and 12 word seed phrases are stored exclusively on your own device. They are never transmitted to our servers. There is no functionality to transmit the 12 word seed phrase.
No Access to Assets: We cannot access, view, or manage your digital assets. We have no "master key" or recovery mechanism.
Bask Wallet is a gateway to the Solana blockchain. When you initiate a transaction:
Our backend proxies your request to third-party nodes or decentralized services.
While our proxy hides your IP address from these third parties, the transaction data itself (which includes your public wallet address) becomes part of the public blockchain ledger.
Public ledger data is permanent and transparent by design; it is not controlled by Bask Wallet and is not subject to this policy.
We believe in full transparency regarding how the software operates.
Your Assets: Because you hold your own keys, you have total "data portability." You can move your assets to any other compatible software at any time without our permission (and in fact, they are not “moved”, but rather the private keys are re-generated using the same algorithm that Bask Wallet uses, which is BIP32/39).
Inquiries: You have the right to know what information is being processed. Since we delete logs every 24 hours, we generally do not hold "historical" data about your usage to provide upon request.
As user-installed software, the accuracy of your wallet information is maintained by the Solana blockchain and your own local device. You maintain full control over the software and can cease all data interaction with our backend at any time by uninstalling the application.
